Justice James Omotosho of the Federal High Court in Abuja ruled on Wednesday that Shaibu’s impeachment was illegal, unconstitutional, null, and void. The court found that the impeachment violated sections 188 and 35 of the 1999 Constitution, as amended.
In addition to reinstating Shaibu, the court ordered that his salaries and allowances be paid from the time of his impeachment in April. Furthermore, the court issued an order of perpetual injunction preventing Governor Obaseki and the Edo State House of Assembly from obstructing Shaibu from performing his duties as Deputy Governor.
Justice Omotosho also directed the Inspector General of Police, Kayode Egbetokun, to restore Shaibu’s security details. The Edo State House of Assembly has announced its intention to appeal the judgment.
